Welcome to SwimPlace! These Terms and Conditions ("Terms") govern your use of the SwimPlace mobile application (the "Service") provided by Thomas James Duffy ("I", "me", or "my").
By accessing or using the Service, you agree to abide by and be bound by these Terms. If you do not agree with any portion of these terms, you are prohibited from using or accessing this Service.
The content provided on this app is solely for informational purposes. Although I endeavor to ensure the accuracy and reliability of the information, I do not guarantee its accuracy, completeness, or appropriateness for any particular purpose.
You commit to use SwimPlace responsibly. Misuse or using it for any illicit or malicious activities can lead to prohibition from further use.
Safety is paramount. When swimming, always prioritize your safety and those around you. This app is a guide and does not replace professional advice, the presence of lifeguards, or personal safety precautions.
To access some features of the app, you may be required to register for an account. You are responsible for protecting your login credentials and are accountable for any activities that occur under your account.
All intellectual property rights in the app, its content, and all materials distributed in connection with it are owned by me. You may not use any content from the app without my prior written permission.
To the fullest extent permitted by applicable law, I will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses.
Your use of SwimPlace is also governed by my Privacy Policy, detailing how I collect, use, share, and store your personal information.
I reserve the right to suspend or terminate your access to the Service at my sole discretion, without notice, for conduct that I believe violates these Terms or is harmful to other users of the Service, me, or third parties, or for any other reason.
I reserve the right to modify or replace these Terms at any time. If a revision is significant, I will make efforts to provide at least 30 days notice before the new terms become effective.
These Terms shall be governed by the laws of your jurisdiction, without regard to its conflict of law provisions.
